Terms of Use

1. Applicability

These Terms apply between the user and the service provider Genyoo (hereinafter referred to as “Genyoo”) regarding the use of Motto!.

These Terms shall constitute the contractual agreement between the user and Genyoo upon the user’s action indicating consent to these Terms on the application.

2. Service Content

This application provides learning functions, conversation practice functions, phrasebook functions, test/lesson functions, and other features to support Japanese language learning.

Certain functions of this application utilize AI to generate responses, provide corrections, offer explanations, and create questions.

This application may display reward advertisements to users who do not have an active Prime or invitation pass, allowing them to experience a limited amount of AI chat after viewing the advertisement, upon which a designated usage allowance is granted. During the validity period of an invitation pass, no advertisement viewing shall be required to utilize the functions provided by the invitation pass.

3. Use of AI Functions

The AI functions are designed to assist Japanese language learning and do not replace the user in verifying facts, making decisions, or performing professional judgments.

AI-generated outputs may contain content that is factually incorrect, incomplete, biased, inappropriate, infringing upon third-party rights, contextually inconsistent, or inconsistent with current circumstances, even if such content appears plausible. AI-generated outputs do not represent the views of Genyoo.

Genyoo does not guarantee the accuracy, completeness, currency, reliability, usefulness, safety, legality, suitability for any specific purpose, non-infringement of third-party rights, or continuous availability of AI-generated outputs, nor does Genyoo guarantee any specific examination pass rate, language proficiency improvement, learning outcomes, or any other result.

Before using, sharing, or publicly disclosing AI-generated outputs, or before making any determination, taking any action, entering into any transaction, or otherwise relying upon such outputs, the user shall independently verify their accuracy and suitability for the intended purpose, and, as necessary, confirm such outputs through reliable sources or consult qualified professionals. The user shall not use AI-generated outputs as the sole source of information or basis for judgment, nor as a substitute for legal, medical, health, safety, financial, or other professional advice.

The user shall determine independently whether to adopt AI-generated outputs, and whether to use, share, publicly disclose, or act upon them. Genyoo’s liability regarding this application shall be limited as provided in Article 14.

Even if the user has a valid Prime or invitation pass, unlimited use of AI functions is not guaranteed. Genyoo may, within a reasonable scope, temporarily restrict the use of AI functions based on usage frequency, usage volume, or other usage conditions, for the purpose of ensuring stable service delivery, preventing misuse, and protecting the usage environment of other users.

4. Prime

Purchase and restoration of Prime shall be conducted through the Apple App Store or Google Play.

Fees, billing periods, currency, taxes, auto-renewal, and other purchase conditions shall be as displayed on the purchase screen of the Apple App Store or Google Play at the time of purchase.

Genyoo may change the price of Prime, taking into consideration service content, operational costs, price levels, tax regulations, exchange rates, conditions of each store or external service, and other reasonable circumstances. If the revised price is to be applied to existing Prime subscriptions, Genyoo shall comply with applicable laws and the conditions of each store, and provide prior notice, obtain necessary consent, and perform other required procedures. Users may disable auto-renewal of Prime through the methods provided by each store prior to the application of the revised price.

Prime shall be automatically renewed at the intervals displayed, unless the user disables auto-renewal through the method prescribed by each store. Cancellation of Prime shall prevent future auto-renewals, and the user shall generally retain access to the applicable features until the end of the paid period.

Regarding cancellation initiated by the user, except as otherwise provided by applicable laws or the conditions of each store, no pro-rata calculation or refund of the paid fee shall be made. In cases of double billing, fraudulent purchase, non-provision of service, or other circumstances eligible for refund, the applicable refund procedures and laws provided by the store where the purchase was made shall govern the response.

Confirmation of purchase or restoration may take time depending on network conditions, the status of each store, or the status of this service.

Payment methods and payment timing shall be governed by the conditions of the store where the purchase was made. Access to the applicable features shall be granted after the purchase is confirmed. Information regarding the seller and other legally required disclosures shall be displayed in the “Disclosure under the Specified Commercial Transactions Law” accessible from the purchase screen of this application.

5. Invitation Pass

Genyoo may issue invitation passes individually to designated users without requiring purchase. An invitation pass is a separate usage right and does not constitute part of a Prime subscription or purchase history.

The validity period, AI usage limit, number of redemptions, and other conditions of an invitation pass shall be determined at the time of issuance or notification. Unless otherwise specified, a standard invitation code may be redeemed by the designated user only once, and transfer, sharing, resale, or reuse for the purpose of circumventing restrictions is prohibited. An invitation pass shall expire upon the expiration of its validity period or upon reaching the AI usage limit. Genyoo may invalidate an invitation pass if there is a reasonable basis, such as misuse, use by a third party, issuance error, or other circumstances making continued provision inappropriate.

If the user’s usage information associated with the redemption of an invitation pass becomes inaccessible due to deletion of application data, reinstallation of the application, change of device, or other reasons, the invitation pass shall not be automatically restored. Upon user inquiry, Genyoo shall reasonably determine whether to reissue the invitation pass within the remaining validity period and remaining usage allowance, after verifying the issuance and usage status.

6. Management of Input Content

The user shall not input passwords, authentication codes, payment information, or other confidential information used for authentication or transactions into this application. The user shall not input personal information of third parties or business confidential information unless the user has legitimate authority to do so and such input is necessary for the use of learning functions.

The handling of content input into this application and learning context shall be governed by the Privacy Policy.

7. Prohibited Activities

The user shall not engage in the following activities:

• Acts that violate laws or public order and morals;
• Acts that infringe upon the rights, reputation, credit, or privacy of others;
• Acts of unauthorized access, circumvention of security functions, evasion of usage restrictions, or imposition of excessive load;
• Automated access, scraping, or abuse of this application, its servers, or related APIs;
• Attempts to obtain, extract, or reproduce non-public information regarding this application or service through fraudulent means or by circumventing security functions;
• Use for the purpose of committing crimes, discrimination, threats, sexual exploitation, violence, or other acts that infringe upon rights or cause harm to others;
• Acts that obstruct the operation of this application or the use of the service by other users;
• Any other acts analogous to the above, which, in light of their purpose or nature, specifically endanger the secure provision of this application or infringe upon the rights of others.

If a violation of the above prohibitions is confirmed, or if emergency measures are necessary to ensure the secure provision of the service or protect the rights of others, Genyoo may, within a reasonable scope, restrict or suspend some or all functions of this application according to the nature or severity of the violation or risk. Where reasonably possible, Genyoo shall notify the user of the reason for such restriction or suspension.

8. Deletion of Device-Stored and Service Data

This application may store data such as settings, conversations, learning profiles, progress, and phrasebooks on the device to enable continuity of the learning experience.

The user may delete service data managed by Genyoo and device-stored data, and restore the application to its initial state, via the “Delete Service Data” option in the settings menu. Details regarding data subject to deletion, data excluded from deletion, and data that may be retained shall be specified in the Privacy Policy.

Deletion of service data does not constitute cancellation of the Prime subscription or deletion of purchase records on the Apple App Store or Google Play. To terminate the Prime subscription, the user must separately perform the required procedure via the subscription management screen of the respective store.

9. Use of External Services and OS Features

Certain functions of this application may utilize external services or operating system features for AI response generation, question creation, speech recognition, translation, and other purposes. Information transmitted to external services, its purpose of use, and handling shall be specified in the Privacy Policy.

If the user directly utilizes functions provided by the Apple App Store, Google Play, or the operating system, the terms presented by each provider to the user shall also apply.

10. Open Source Licenses

This application utilizes open-source software. License information for each software component may be reviewed via the License screen within the application.

11. Target Age

This application is intended for users aged 18 and above. Users under the age of 18 are not permitted to use this application.

12. Changes, Interruption, and Termination

Genyoo may modify the content of this application or temporarily interrupt all or part of this application for reasons including maintenance, security assurance, prevention of misuse, changes or cessation of external services, requests from laws or administrative authorities, or other necessary circumstances for service provision. Where reasonably possible, Genyoo shall provide prior notice to users.

In the event of disasters, major failures, security emergencies, or other circumstances where prior notice is impracticable, Genyoo may interrupt all or part of this application without prior notice. In such cases, Genyoo shall provide necessary notice to users as soon as reasonably possible.

Genyoo may terminate all or part of this application for reasonable business, technical, or legal reasons. Where reasonably possible, Genyoo shall provide prior notice through in-app notifications, public websites, each store, or other appropriate means, and shall take necessary measures to cease new purchases and auto-renewals.

If a paid usage period is valid at the time of termination of this application, Genyoo shall generally continue providing the applicable service until the end of such period. If continuation of service is not feasible, Genyoo shall provide appropriate remedies, including refunds corresponding to the unprovided period, in accordance with applicable laws and the conditions of the store where the purchase was made.

13. Amendment of These Terms

Genyoo may amend these Terms in accordance with applicable laws if such amendment is suitable for the general interest of users, or if such amendment does not contradict the purpose of the contract and is reasonable in light of the necessity of amendment, the appropriateness of the amended content, and other circumstances.

When amending these Terms, Genyoo shall notify users of the amendment, the amended content, and the effective date thereof by means of in-app notification, public website, or other appropriate methods prior to the effective date. For amendments that may adversely affect users, Genyoo shall provide a reasonable notice period.

If applicable laws require individual user consent for the amended Terms to take effect, Genyoo shall request explicit consent again through this application prior to applying the amended Terms. If the user does not agree to the amended Terms, the user shall discontinue use of this application and, if necessary, disable auto-renewal of Prime via the respective store.

14. Limitation of Liability

The limitations of liability under this Article shall not apply if damage to the user is caused by Genyoo’s intentional act or gross negligence, or if liability cannot be limited under the Consumer Contract Act or other applicable laws.

If damage to the user arises from Genyoo’s slight negligence in relation to this application and Genyoo is liable for damages, such liability shall be limited to damages that are typical and direct, and that have a reasonable causal relationship with Genyoo’s act.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan.

In the event of any dispute between the user and Genyoo regarding this application, the Tokyo District Court or the Tokyo Summary Court shall be the agreed court of first instance. This provision shall not impair any user’s right to choose a court as permitted under applicable laws.
